ERMAZ Terms of Use

Ermaz LLC (“Ermaz”, “we”) is a limited liability company formed in the State of Wyoming, United States. Ermaz manufactures websites from a description of your business. By using the service you agree to these terms.

You are contracting with Ermaz LLC, a Wyoming limited liability company. You can reach us at hello@ermaz.app. That address is the contact point for every notice, question, request or complaint under these terms.

Terms common to both

Acceptable use

• No deceptive, illegal or harmful use: phishing, fake login or payment pages, impersonation of real people or brands, scams, malware, or anything infringing others' rights.
• The AI refuses such briefs, and what is manufactured is logged. We may unpublish or suspend anything that breaches these terms or the law. Where we reasonably can, we will tell you first and give you a chance to put it right.

Your content and your responsibility

• What Ermaz manufactures from your brief is yours to use. You are responsible for what you ask it to make, for what you publish, and for the data you and your users put into it.
• AI-generated output can be wrong. Review it before relying on it, particularly anything legal, financial or safety-related.
• You are responsible for having the right to use the data you load, and for meeting the obligations you owe the people that data is about. See the privacy policy, which explains the division of responsibility.

Payments

• Payments are processed by Paddle, our merchant of record. Your contract of sale is with Paddle; these terms govern the service itself. We never receive or store your card details.
• Refunds are governed by the refund policy, which forms part of these terms. Where the two differ, the refund policy applies.

What things cost

• The preview is free. You describe the business, Ermaz manufactures the site, and you see it working before anything is charged.
• Launch is $149, paid once. It makes the site permanent, with hosting, HTTPS and your own domain included, and the full source code is yours to download. A website with a matching installable app build is $199.
• A revision on a launched site is $19, charged only if it ships. If the factory cannot complete it, you are not charged. Factual corrections, such as a phone number, hours or a price, are free.
• A signed Google Play package is $49, charged only if it is produced.
• Website Care is $39 per month per site, optional, and covered below.

Changes to the service

Ermaz is actively developed. Features, interfaces and the way sites are built and served change, and improvements are applied centrally rather than site by site. We may change or withdraw features. For a change we expect to break how you use a manufactured product, we will give reasonable notice by email.

No warranty, and limits

The service is provided as-is, without warranty of any kind. To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the twelve months before it arose. Nothing here excludes liability that cannot lawfully be excluded.

Website Manufacture

• Free previews run on shared infrastructure for 7 days and are then taken offline, or earlier if they breach these terms.
• Launched sites are hosted with HTTPS for as long as Ermaz operates the service, at no further charge. That is not a promise Ermaz will exist indefinitely: if the service winds down we will give at least 60 days' notice by email. Your full source code is included with every Launch precisely so you are never dependent on us, it runs on any static host.

Website Care, $39 per month

• Website Care is optional. A launched site works without it and stays live without it. You can add it or drop it at any time.
• It covers three ongoing services on one site: a weekly maintenance visit, a weekly SEO article, and an automated first reply to inquiries that arrive through the site. The first reply is written by a language model and sent on your behalf, and the person who receives it is told the reply is automated.
• The price is $39 per month per site, and it covers all three services on that site.
• To cancel, use the cancellation link in your Paddle receipt email, or email support@ermaz.app. There is no cancellation fee. Care runs to the end of the month you have paid for and then does not renew.
• Cancelling Care never takes your site down. The one-time Website Manufacture payment already covers hosting. Only the weekly work stops.

Your enquiries, and your data

• Enquiries from your site are yours. When a visitor sends the contact or booking form, Ermaz emails it to you and keeps a copy in your records so you can read it again. Ermaz does not claim ownership of it, does not sell it, and does not use it to advertise. Any photographs attached to an enquiry are kept for 90 days and then removed.
• Export and deletion. Email privacy@ermaz.app and we will send your account, your builds and your enquiries in a standard machine-readable format at no charge, normally within 5 working days, or delete them. We state this plainly because a promise of portability is worth nothing unless someone performs it. See the privacy notice for the full detail.

Availability

• A launched site is static and served from a content network with HTTPS, which is fast and has little to break. We aim to keep it available and will use commercially reasonable efforts to do so, but we do not offer a guaranteed uptime percentage, service credits, or a recovery-time guarantee.
• Because your full source code is included with every Launch, you are never dependent on us: your site runs on any static host.

Third parties we rely on

Manufacturing and hosting your site involves other companies: Netlify (hosting), OpenAI (manufacturing the site from your description), Unsplash (photography) and Google Fonts (typefaces), Resend (delivering your enquiries by email), and Paddle (payments). Their failures can affect the service, and their terms apply to their parts of it.

Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Disputes arising from these terms or from the service go to the state or federal courts sitting in Wyoming, and you and Ermaz agree to their jurisdiction.

This does not remove rights you hold where you live. If you are a consumer in the EU or the UK, or anywhere else with mandatory consumer protection law, you keep those rights in full, including the right to bring proceedings in the courts of your own country. Nothing in this clause overrides a law that cannot be contracted out of.

Before going to court, email us. Most problems are cheaper to fix than to argue about.
